These Terms & Conditions ("Terms") govern your use of the Attendify website, mobile applications, and admin dashboard (collectively, the "Service") operated by React Wave Labs, registered in Kuwait ("Attendify", "we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.
1. Who can use the Service
- You must be at least 18 years old, or the age of legal majority in your country.
- You must have the authority to enter into these Terms on behalf of your employer (if you are signing up for a company account).
- You agree to provide accurate registration information and to keep it up to date.
2. Your account
- You are responsible for safeguarding your account credentials and for any activity carried out under your account.
- You agree to enable two-factor authentication (OTP) where the Service offers it.
- You will notify us immediately at support@reactwavelabs.net of any suspected unauthorised access.
3. Plans, billing & the Free plan
- The Free plan supports up to 5 employees, with no time limit and no payment details required.
- Paid plans (Basic and Advanced) are billed monthly or annually in advance. Annual billing is paid for 10 months and gives you 2 months free.
- You can upgrade, downgrade, or cancel your plan at any time from the admin dashboard. Cancellation takes effect at the end of the current billing period.
- We do not refund partial months. We will, however, refund any annual prepayment for unused months in the case of a service interruption that lasts more than 14 consecutive days and is caused by us.
- Prices are exclusive of any applicable taxes. Where required by law (for example, KSA or UAE VAT), tax will be added at the prevailing rate.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including processing the data of individuals without a lawful basis.
- Attempt to reverse-engineer, decompile, or extract the source code of any Attendify software.
- Attempt to bypass security or rate limits, or gain unauthorised access to any part of the Service or to other customers' data.
- Use Attendify to send unsolicited messages, spam, or to monitor anyone without their knowledge of company policy.
- Submit false or misleading attendance records (for example, by spoofing GPS location or impersonating another employee).
5. Customer data
- You retain all rights to the data you upload to or generate within Attendify ("Customer Data"). We claim no ownership over Customer Data.
- You grant us a limited licence to host, process, and display Customer Data only as necessary to provide the Service to you.
- You are responsible for ensuring you have the legal basis to upload Customer Data, for example by informing your employees about the use of Attendify and obtaining any required consents.
- On termination, we will, on request, provide a one-time export of your Customer Data in a common format (CSV / Excel) within 30 days, after which the data may be deleted.
6. Service availability
We make reasonable efforts to keep the Service available 24/7, but we do not guarantee uninterrupted availability. Planned maintenance will be announced in advance through the admin dashboard. Unplanned outages will be communicated as soon as practicable. We are not liable for service interruptions caused by factors outside our reasonable control (for example, internet backbone failures, third-party cloud-provider outages, or force-majeure events).
7. Suspension & termination
- You may terminate your account at any time from the admin dashboard.
- We may suspend or terminate your access if (a) you breach these Terms, (b) your account is used for fraud or illegal activity, (c) your account remains in non-payment beyond 30 days, or (d) we are required to do so by law.
- Where reasonable, we will give you notice and an opportunity to remedy the issue before suspension.
8. Intellectual property
The Attendify name, logo, software, design, and content (other than Customer Data) are owned by React Wave Labs and are protected by Kuwait and international intellectual-property law. You may use them only as needed to access the Service.
9. Warranties & disclaimers
Attendify is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that it will meet every specific requirement of your business.
10. Limitation of liability
To the maximum extent permitted by Kuwait law, Attendify's aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service is limited to the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity.
11. Indemnity
You agree to indemnify and hold us harmless against any third-party claim arising from (a) your breach of these Terms, (b) your violation of applicable law, or (c) your unlawful use of Customer Data.
12. Privacy
Our use of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.
13. Changes to the Service or these Terms
We may modify or discontinue parts of the Service from time to time. We may also update these Terms. Material changes will be notified by email and via an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law & dispute resolution
These Terms are governed by the laws of the State of Kuwait. Any dispute arising out of or in connection with these Terms or the Service that cannot be resolved through good-faith discussion within 30 days will be subject to the exclusive jurisdiction of the competent courts of Kuwait.

Disclaimer. These Terms have been drafted in plain language and align with common Kuwait commercial practice but they are not legal advice. Customers signing up for paid plans receive a separate Customer Agreement that governs the commercial relationship; that document prevails in case of conflict.
